The Swisslinx App provides you with its services under the condition that you accept the General Terms and Conditions of Use below, the purpose of which is to set the technical, practical and legal terms of our relationship. When you install the Swisslinx App you confirm that you have full and complete understanding of these General Terms and Conditions of Use, which you unconditionally accept and agree to respect.
As an employee you therefore commit to use the Swisslinx App solely during your employment with us. You further agree to notify Swisslinx if you receive false information and keep such falsely transmitted information confidential, respectively, destroy it upon recognition.
The Swisslinx App Privacy policy is an integral part of these General Terms and Conditions. By accepting these terms you automatically accept our Privacy Policy.
Article 2 - Access Conditions
The Swisslinx App is only accessible to people currently employed at Swisslinx or one of its affiliates. Access to the app ceases 30 days after termination of the contractual relationship.
Should you not have been given access after start of your employment, please contact us. Should your access prevail after termination thereof, inform Swisslinx and cease the use of the Swisslinx app.
Within the limits of the laws and regulations, the access to the Swisslinx App may be revoked at Swisslinx sole discretion.
Article 3 - Services provided and Cost of use
The Swisslinx App provides access to information related to your employment contract, payments and general information regarding working and living in Switzerland. The use of the Swisslinx App is free of charge.
Article 4 - Protection of Personal Data
The Swisslinx App Privacy Policy is an integral part of these General Terms and Conditions. It applies and provides all necessary information regarding the protection of your personal data.
Article 5 - Intellectual Property
Any trademarks, logos, graphics, photos, animations, videos or texts appearing in the app are the intellectual property of Swisslinx and may not be reproduced, used or represented without specific authorization from Swisslinx under threat of legal proceedings.
In accordance with these General Terms and Conditions of Use, you agree to use that intellectual property for personal use only, and therefore not to modify, copy, reproduce, download, publish, share or commercialize that information for any purpose whatsoever, and in particular, for sales and marketing purposes.
Article 6 - Modification
Swisslinx reserves the right to modify, improve or develop at any time the Swisslinx App and the services offered therein as well as these General Terms of Use. Such modifications will come into effect as soon as Swisslinx, in its sole discretion, activates them or publishes them on the Swisslinx App.
Furthermore, with new versions you may not be able to access information on our servers until you downloaded the new version from the relevant store.
Article 7 - Termination and Force Majeure
Swisslinx reserves the right to terminate the use of the Swisslinx App with immediate effect and in accordance with the Swiss Code of Obligations in case of breach of the General Terms of Use.
Swisslinx furthermore reserves the right to terminate the use of the Swisslinx App following a seven (7) days' notice in any other case and in accordance with the Swiss Code of Obligations.
In any case of Force Majeure that prevents Swisslinx from providing the services on the app, Swisslinx reserves the right to suspend all accounts.
Access to the Swisslinx App is tied to your employment at Swisslinx or any of its affiliates. In the event of termination of your employment, regardless of the reason, your access to the App will be revoked within thirty (30) days of termination.
Article 8 - Access to Service and Service Continuity
In accordance with these General Terms and Conditions of Use, Swisslinx cannot be held liable for any disruption to the app functionality and service continuity. More precisely, Swisslinx has no responsibility or liability for the deletion or accuracy of any content, including your own content.
To access the Swisslinx App, you must use a tablet or a phone with an Internet connection including parameters that allow for adequate access to the app. Swisslinx does not guarantee that the app will be compatible with your mobile device or your tablet.
Swisslinx cannot be held responsible for any malfunction, access denial or wrong user condition caused by the device, the Internet provider, network congestion, or any other reason not associated with Swisslinx. In addition, you alone are responsible for paying all telephone and Internet access fees incurred through the use of your device, and Swisslinx cannot in any case be held responsible for the payment of those fees.
Article 9 - Accuracy of information provided
Swisslinx cannot be held liable for the accuracy of the content made available. Should you be able to download any content that is not intended for you, you agree to inform Swisslinx as soon as you become aware that the downloaded content was not intended for you and agree to delete the respective content.
Should you find that information concerning yourself is incorrect, you agree to make Swisslinx aware of it and ask for it to be corrected.
Article 10 - Links to other websites
Parts of the Swisslinx App may contain third party content. Providers of other content are responsible for ensuring that such material complies with international and national law. Swisslinx cannot be held responsible for any third party content or error, or for any omission or inaccuracy in any third party content.
Article 11 - Liability
You agree to inform Swisslinx as soon as possible of any violation of current legislation of which you are made aware and which would specifically derive from the content or purpose of an ad displayed in our app. Based on the elements you have provided, Swisslinx reserves the right to delete as a matter of right, without prior warning or compensation, the relevant information or hypertext link.
Swisslinx cannot be held liable for any damage that may arise from the use of the Swisslinx mobile application.

YOUR PERSONAL DATA
This policy concerns the use and the processing of all data via the Swisslinx app in the context of your employment at Swisslinx.
What personal data is collected by the Swisslinx app
The Swisslinx App collects information from the use of your mobile device such as the log in time, location data, IP addresses, the device, the operative system of the device, the browser and any request or action done via the app.
We store change requests in your profile, as well as messages you send to Swisslinx via the app including when the message was sent.
Furthermore, when you sign documents on the app or provide information via the app or if you communicate with Swisslinx via the app mail communication tool, we collect and store this data on our internal and external servers.
The Swisslinx app also gathers the information regarding your email address and the password you provided to access the app if you selected the option "Keep me logged in".
All the personal data that you find on the app is data that you expressly consented to the Swisslinx Group of companies storing using, supplying or transferring.
Why is your personal data collected by the Swisslinx app
The Swisslinx App's sole purpose is to enable you to access information that we store as your employer.
The app allows you to download copies of your documents which include your salary certificate, useful information, documents that you have to sign, personal documents and official documentation (BVG, salary certificates...), or any document related to your contract and to your employment.
How is personal data used by Swisslinx
Access to the Swisslinx App is only granted to employees of the Swisslinx Group of companies.
You have access to the app with your personal access code that must be kept personal. By giving away the access code, you hand over to third parties the access to your personal data.
We collect and store the personal data on our internal and external systems and use the information for the purpose of your employment.
We grant you access to the above mentioned personal data via the app for the purpose of your employment at Swisslinx, to facilitate your access to important documents relating to your employment and to allow you to have access to the personal data we hold on you.
The Swisslinx app does not store any data on your device unless you actively download files on your device. Once any information is downloaded from the Swisslinx app, Swisslinx no longer has any form of control over it and consequently refuses any responsibility regarding the handling and/or disclosure thereof.
By downloading information from the app onto your mobile device or computer, you physically store data on your own electronic devices. As such you make the data available on your mobile devices to anyone who has access to these devices.
All the data the app accesses is stored on servers in Switzerland.
Swisslinx does not share any data with third parties unless you give express consent or required by law.
After termination of your employment contract you will be able to access the Swisslinx app for a duration of 30 days.
Your personal data will be stored for a period of 10 years on our internal and external servers.
Your personal information can be stored and processed in countries where we have our offices or in which we engage service providers, within or outside of the EEA/EFTA. All data will be treated confidentially and will not be used for any other purposes than those explicitly agreed to by the person concerned.
We respect and apply the Swiss data protection laws, in particular the Swiss Data Protection Act as well as the EU General Data Protection regulation, effective from 25th May 2018.
You can access and update your personal data on the app. Your personal details are in the "Profile" section, email and password are editable in the "Settings" section. You can also withdraw your consent at any time by contacting dataprotection@swisslinx.com.

Under GDPR you have the following rights, however there are restrictions which can apply, as some of the rights are not absolute.
We engage all our efforts and have taken appropriate measures to ensure the security of our app as well as of the transmission and access of all data in the context of our services. Please use other means of communication if you deem this necessary.
